Agreement
By accessing or using BANDcore ("the Service"), you agree to be bound by these Terms of Service. BANDcore is a music-business platform owned and operated by BANDcore LLC, a California limited liability company. The Service includes MERCHcore POS, ROADy and ROCKy AI agents, the FANcore companion app, and related features. If you do not agree to these terms, do not use the Service.
The Service
BANDcore provides a band-side platform (point-of-sale, inventory, sales tracking, AI advisors, fulfillment dispatch, financial reporting) and a free companion fan app (FANcore: scrapbook, FLASH messages, purchase history, ROCKy). The Service is provided "as is" and may be updated, modified, or discontinued at any time.
Accounts
Band accounts require an active subscription. You must provide a valid phone number and band information. Band leaders are responsible for the boothtenders, sellers, and other staff they invite to their account, and for all activity under those accounts. You must not share login credentials or allow unauthorized access.
Fan accounts are free and require only a phone number for authentication. Fans may use FANcore as long as the bands they follow remain active BANDcore subscribers — see the FANcore section below.
Subscription Plans & Fees
BANDcore offers five subscription tiers, billed monthly:
- Garage — $29/mo, 0% platform fee on transactions
- Opener — $99/mo, 0% platform fee on transactions
- Touring — $249/mo, 1.0% platform fee on card transactions
- Headliner — $499/mo, 1.49% platform fee (coming soon)
- Arena — $1,999/mo, 1.99% platform fee (coming soon)
Platform fees apply only to in-venue card transactions and are collected as a Stripe application fee on each charge. Platform fees do not apply to cash, Venmo, Zelle, Cash App, or PayPal transactions recorded in the app.
In addition to platform fees, Stripe charges payment processing fees (currently 2.9% + $0.30 per card transaction; rates set by Stripe and subject to change). Bands absorb Stripe processing fees as a cost of doing business; fans see one price regardless of payment method.
Subscriptions are auto-renewing. You may cancel at any time from your dashboard or by emailing hello@bandcore.band. Cancellations take effect at the end of the current billing period; we do not provide prorated refunds for partial months unless required by law. Fees and tier features are subject to change with reasonable notice.
Sales & Transactions
All sales recorded through the Service are final and immutable in the BANDcore record. Bands set their own return and exchange policies and are responsible for honoring them. BANDcore facilitates the recording of sales but does not enforce return or exchange terms between bands and fans.
Bands are responsible for the accuracy of their inventory, pricing, product descriptions, and tax compliance.
California buyers: California Civil Code § 1723 grants buyers the right to a refund within a defined window for items purchased without a posted refund/return policy. Bands selling in California should post their policies clearly to qualify for "no refund" or "all sales final" treatment.
Booth-to-Doorstep & Fulfillment
Shipping label generation, in-app cart upsell, and fulfillment dispatch are rolling out in stages. Some features described in BANDcore marketing materials may not yet be available to all subscribers. Availability of fulfillment features is determined by tier and rollout cohort.
When fulfillment is live for your tier, BANDcore will email shipping label PDFs to band leaders after each show for orders placed through FANcore's in-app cart. Bands are responsible for printing labels, packaging merch, dropping off with carriers, and shipping orders. Bands warrant they will fulfill shipped orders within 14 business days of receipt unless they disclose a longer fulfillment window at the point of sale.
BANDcore generates shipping labels via third-party providers (e.g., Shippo, EasyPost — provider may change). BANDcore is not liable for shipping delays or transit times; lost, damaged, or stolen packages; addresses entered incorrectly by fans; customs holds, duties, or international restrictions; postage or label cost overruns; or carrier service disruptions.
Bands handle returns, exchanges, and customer service for shipped items. BANDcore may surface return-related tools but does not adjudicate disputes between bands and fans.
Taxes
Bands are solely responsible for sales tax collection, reporting, and remittance in every jurisdiction where they operate. BANDcore does not collect or remit sales tax on bands' behalf and does not provide tax advice. BANDcore generates sales reports (per show, per item, per period) bands can use for tax preparation.
Bands operating in California must collect California sales tax per CDTFA rules. Bands selling across state lines may have nexus obligations in other states; consult a tax professional.
IRS Form 1099-K: bands receiving $600 or more in gross payments via Stripe in a calendar year will receive a 1099-K from Stripe (not from BANDcore). The reporting threshold is set by the IRS and subject to change.
Tips
Tips paid through BANDcore checkout are voluntary, never mandatory service charges. 100% of tips flow to the band; BANDcore does not take a cut of tips.
Tips received through BANDcore are reportable income at federal and state levels. The "No Tax on Tips" provision enacted under the One Big Beautiful Bill Act of 2025 (in effect for tax years 2025 through 2028) allows individual tip recipients to deduct up to $25,000 per year of qualifying cash tips from federal taxable income, subject to phase-outs and IRS guidance. Bands should consult a tax professional regarding eligibility and reporting.
AI Agents (ROADy & ROCKy)
ROADy (band advisor) and ROCKy (music historian) are AI assistants powered by Anthropic's Claude API. Their responses are informational only and do not constitute legal, financial, medical, accounting, tax, or other professional advice. Bands and fans should not rely on AI responses for binding business decisions, legal interpretation, or material financial commitments without independent verification.
BANDcore is not liable for AI-generated content. Users assume responsibility for verifying important information before acting on it. AI responses may be inaccurate, outdated, or incomplete.
FANcore (Free Fan App)
FANcore is provided free to fans of bands subscribed to BANDcore. Fans do not pay subscription fees; bands' subscription fees cover their fans' FANcore access. BANDcore reserves the right to limit, modify, or discontinue FANcore for fans of cancelled band accounts. Fans retain access to their own scrapbook data subject to the Privacy Policy's data retention terms; fans may export or delete their scrapbook at any time.
FANcore is not a marketplace. Bands set prices, fulfill orders, and own the fan relationship. BANDcore facilitates discovery, ordering, and notifications only.
SMS Communications
Program name: BANDcore SMS Notifications. By using the Service, you consent to receive SMS messages related to your account, including authentication codes, real-time sale alerts, low stock alerts, end-of-show sales summaries, and FLASH messages. Message frequency varies based on your activity — typically up to 50 messages per show date for active band leaders, and only verification codes for one-time signups. Intellectual Property
BANDcore, MERCHcore, FANcore, ROADy, ROCKy, TOURcore, and related branding are the intellectual property of BANDcore LLC, sole owner Jeremy Swan. The Service and its software are owned by BANDcore LLC. You retain ownership of your content (band info, merch photos, sales data, fan database). By uploading content to the Service, you grant BANDcore LLC a non-exclusive, worldwide license to store, display, and process that content as needed to operate the Service.
Limitation of Liability
The Service is provided "as is" without warranties of any kind. BANDcore LLC's total liability arising from these Terms is limited to the fees you have paid to BANDcore LLC in the 12 months immediately preceding the claim.
BANDcore LLC is not liable for: lost revenue or profits; missed sales; SMS or email delivery failures or delays; merch loss, damage, or theft; venue conflicts or cancellations; third-party platform changes or outages (including Stripe, Twilio, Anthropic, shipping carriers, Supabase, Vercel); AI agent inaccuracies; or force majeure events including but not limited to public health emergencies, natural disasters, war, civil unrest, regulatory changes, internet outages, and cyber attacks.
Termination
Either party may terminate at any time. Bands may cancel from the dashboard or by emailing hello@bandcore.band. BANDcore LLC may terminate or suspend accounts for breach of these Terms, fraud, abuse, or non-payment. Upon termination, your access to the Service will be revoked. Sale records and financial data will be retained as required by law and as described in the Privacy Policy.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active users via email or SMS. Continued use of the Service after changes take effect constitutes acceptance.
